Terms and Conditions of Hire

THE HIRER will, during the period of the hiring, be responsible for the supervision of the equipment, its care, safety from damage however slight or change of any sort, and the behaviour of all persons of all ages using the equipment whatever their capacity. The Hirer acknowledges that he has read and understands any relevant operating and safety instructions supplied with the equipment. Loca-Motion excludes any liability for injury, loss or damage caused to any person using the equipment.

In all hiring contracts (unless expressly agreed with the Hirer to the contrary or ones that have operator attendance) a refundable bond of 200 euros in the form of cash or cheque is required. Such bond to be returned to the Hirer within 48 hours of return of the goods unless the hired equipment has been damaged or lost during the period of hire and in such circumstances the said bond will be utilised in discharge of or in part payment of those repairs/replacements. The Hirer shall indemnify Loca-Motion for the cost of repair of any damage done to any equipment howsoever arising, which may occur during the period of the hiring as a result of the hiring.

THE HIRER shall not use the equipment for any purpose other than that described in the hiring agreement, and shall not sub hire or use the equipment or allow the equipment to be used for any unlawful purpose or in any unlawful way.

IF ANY UNIT is returned outside the hire period for whatever reason an additional charge of 150 euros per day or the daily hire charge whichever shall be the greater, will be payable by the Hirer to Loca-Motion for each day or part day until the unit comes into the possession of Loca-Motion.

THE HIRER shall be deemed to have inspected the equipment and to have agreed that it is supplied in good working condition unless he brings to the attention of Loca-Motion within two hours of coming into possession of the equipment any faults noted by the Hirer.

PUBLIC LIABILITY is excluded in its entirety following any claim or injury to any third party or employee whether directly or indirectly related to the use of drugs and/or alcohol.

IF THE HIRER wishes to cancel the booking more than one calendar month prior to the date of hire he may do so subject to paying an administrative charge amounting to the deposit paid upon the signing hereof. Any subsequent cancellation for whatever reason shall mean the Hirer will pay the full cost of hire of the equipment unless Loca-Motion in its absolute discretion considers otherwise.

AT THE END of the hiring the Hirer shall be responsible for leaving the equipment in a clean and tidy condition otherwise Loca-Motion shall be at liberty to make an additional charge. If the Hirer fails to return the equipment in a clean and tidy condition Loca-Motion are entitled to levy a further charge of 45 euros for the cleaning and/or servicing of the equipment.

IN THE EVENT of the equipment or any part thereof being rendered unfit for the use for which it has been hired Loca-Motion shall not be liable to the Hirer for any resulting loss or damage whatsoever.
